Conditions of sale and order

hereinafter referred to as “Sports Partner” and the persons who wish to purchase through the xxxxxxxx Internet Website hereinafter referred to as the “User”.

2. These conditions apply to each franchised unit of the Sports Partner brand.
3.º The parties agree that purchases made through this website shall be governed exclusively by this contract to the exclusion of any conditions previously available on the Website.
4.º A typographical error may occur and lead to an error in the price. We reserve the right to rectify the price should this happen.
ARTICLE 1 – SUBJECT MATTER
- The purpose of these general terms and conditions of sale is to provide and define all the information required by the user regarding the methods of ordering, sale, payment and delivery of purchases made on the website. These conditions regulate all the steps required to place an order and guarantee the follow-up of this order between the Contracting Parties.
ARTICLE 2 – ORDER
- The User can send his/her order through the purchasing process referred to on the website above as “confirm”, after having used the online device by selecting “Add to shopping cart”:
- To submit their order the User must:
a) Register on the website providing the requested information, namely Address, Telephone Contact, E-mail.
b) “Login” (providing a combination of e-mail and password chosen by the User upon registration).
c) Complete the information and choose the options available during the “check-out” process (delivery and invoicing address; shipping method; payment method).
- By placing an order, the user fully and completely accepts the prices and description of the products available for sale as well as the general conditions of sale which shall be the only ones applicable to the contract thus concluded.
- Sports Partner reserves the right to cancel an order in the event of a typographical error in both the price and the description of the product.
Sports Partner will honour orders received online only up to the limit of available stocks, in the absence of availability of the product, it undertakes to inform the user as soon as possible. - If payment of the same is not received or validated in the case of payment at the end of the period, within this period, the order may not be validated. Any amount received after this date will be returned or used in a new order.
ARTICLE 3 – DELIVERY
- Orders will be delivered by a Sports Partner distributor and will not incur any additional costs beyond those established at the time of purchase. It can only be changed in an unforeseen and exceptional situation.
ARTICLE 4 – PAYMENT
- All prices PVP W/o VAT Included
- If there is an increase in the price of any product, deliveries will be invoiced with the price that was considered in the order process.
ARTICLE 5 – CANCELLATION AND RETURNS POLICY
- The cancellation or return process is handled on a case-by-case basis by A Sports Partner. The request must be sent in writing to the unit’s e-mail address by 12 noon of the day prior to delivery. The instructions for cancellation or return of the goods shall be sent by Sports Partner by the same means of communication.
- Whenever possible the return should be made by the same means of payment, but if this is not possible, the user must present proof of payment and ownership of account or card, so that the return can be made by Bank Transfer.
- Sports Partner undertakes to reimburse the user within 30 days.
- Sports Partner has a complaints book. Please contact the person in charge to request it.
ARTICLE 6 – PRIVACY POLICY
- The treatment of your data is done in compliance with the legislation on the protection of personal data. The same, subject to computer processing, will appear in the Sports Partner database(s) and are intended for registration and presentation of other products and services, as well as institutional information, to be made available by them.
- Its provision is optional and is guaranteed under the law, the right of access, rectification and cancellation of any data that concerns you directly, personally or in writing, directly to the address on the home page of this website.
Once your order has been received and processed, items in stock will be dispatched within 48-72 business hours. Items out of stock will be shipped as soon as we receive them.
Destination times vary depending on the distance and accessibility of your city. Some cities, including sparsely populated cities, may require additional time because the carrier may have to transfer to a local carrier. Most items will be received in 5-7 days but some may take up to 15 days.
When your order is shipped you will receive an email from our shipping department confirming that your purchase has been shipped, and providing information about the carrier, tracking number and instructions.
Your shipment leaves our facility in perfect condition. When it arrives please check for damage or incorrect quantities before signing for it. Any damage to contents should be notified on the bill of lading for claim against the carrier. Failure to inspect the package before signing limits our liability as well as that of the carrier.
Heavy orders are shipped by carriers who provide delivery at the curb. This means that the company is only obligated to take the parcel to your curb. It is your responsibility to help get the parcel off the truck and into your home. It is useful to have a handcart available. For an additional fee you can request a truck with a platform lift.
For liability reasons, carriers are prohibited from taking packages inside. If you live in a location with limited access to your property, you will be responsible for transferring the parcel from the nearest access point.

Incorrect shipping information
If an order is returned or there are additional charges due to incorrect delivery address or incorrect telephone number, the customer will be responsible for all delivery costs.
Returns
Returns can only be initiated within 15 days of purchase. All returns must be approved before sending a product back. All products must be in original packaging and in new condition. If a returned product is not in original packaging and in new condition it will not be accepted.
Refund does not include delivery and carrier costs in both directions.
Delivery costs
When your order is completed, with your full address, the system will calculate the cost of delivery. This amount depends on the weight and volume of your order and the distance from our warehouse. For certain destinations, it is not possible to send our products. With your order, country and postal code you will receive the shipping cost before any payment is made.
